Travel package and experiences terms and conditions

1. 1. Applicability

   1. The products and services offered by American Airlines, Inc. are subject to rules that customers need to accept as part of a legally binding contract in order to buy and enjoy them. These Travel Package and Experiences Terms and Conditions explain the rules which apply to the products and services, including travel packages ("Package") and experiences ("Experiences"), offered by American Airlines, Inc. under the American Airlines Vacations platform. The American Airlines Vacations platform is also subject to the AA Platform Terms Opens in a new window , which are supplemented by the Terms (as defined below).
   2. These American Airlines Vacations Travel Package and Experiences Terms and Conditions, together with any terms set forth in a Package or Experience confirmation email and other related emails sent to you in connection with a Package or Experience, constitute the "Terms". These Terms apply in addition to any other terms and conditions between you and American Airlines, Inc. (hereafter referred to as "American Airlines Vacations" for purposes of these Terms). These Terms apply regardless of where you live or where you are located when you book or use Packages or Experiences.
   3. These Terms are binding upon you as either the booker of a Package or Experience (the "Booker") or a person traveling under such Package or participating in such Experience ("Participant"). The Booker may be a travel agency. By booking a Package or Experience, or by clicking accept or agree to these Terms if this option is made available to you, the Booker on behalf of itself and each Participant agrees to be bound by these Terms without limitation or qualification, so please carefully review these Terms before proceeding. If you do not intend to be legally bound by these Terms, do not book a Package or Experience, travel under a Package, or participate in an Experience.
   4. American Airlines Vacations may collect, process, and share personal information in connection with its products and services (including Packages and Experiences) in accordance with its Privacy Policy (the "Privacy Policy"). By booking a Package or Experience, traveling under a Package, or participating in an Experience, each Booker and Participant acknowledges that it has read the Privacy Policy Opens in a new window .
   5. American Airlines Vacations may modify these Terms from time to time, without notice or liability, and any such revisions are prospectively binding on you for your future bookings. Your booked Packages and Experiences are subject to the Terms in effect at the time you booked the applicable Package or Experience. You should periodically visit this page when you book or participate in Packages or Experiences to review the then-current agreement that binds you.

2. 2. Booker and Participant Roles and Responsibilities

   1. The Booker will be the point of contact between American Airlines Vacations and all Participants. Each Booker and Participant agrees that American Airlines Vacations will be entitled to rely upon the Booker's instructions relating to Participants, and that American Airlines Vacations may refer any inquiries from such Participants to the Booker, including payment or refund inquiries.
   2. By booking a Package or Experience, the Booker hereby represents and warrants to American Airlines Vacations that:
      • The Booker has the express authorization from all Participants to make such booking and speak on their behalf, including authorization to use Participants' personal information for such purposes;
      • The Booker will comply with the American Airlines' Privacy Policy and ensure that the Participants have the opportunity to read the American Airlines' Privacy Policy; and
      • The Booker has made any other disclosures and obtained any other approvals required by applicable law in connection with adding such Participants to a Package or Experience and designating them to receive the services and related benefits from American Airlines Vacations and applicable third parties.
   3. You acknowledge and agree that all payment obligations will be remitted by the Booker to American Airlines Vacations in accordance with these Terms.
   4. The products and services offered by American Airlines Vacations - including all rates for air travel, hotel rooms, rental cars and all other components offered as a component of a Package or Experience - are exclusively for personal leisure (e.g., vacation). You acknowledge and agree that you will not use any Package or Experience for business use, including, but not limited to, conventions and meetings.

3. 3. Experiences

   1. All Experiences are non-transferable and cannot be used by any persons other than Participants.
   2. Each Experience is non-refundable (except if cancelled by American Airlines Vacations) upon redemption, unless the particular Experience contains terms or conditions that specifically set forth return, cancellation, change or exchange policies.
   3. Experiences displayed on American Airlines Vacations' website may not be available at all times and may be substituted or discontinued at any time. Limited quantities are available.
   4. Experiences are provided one per person only on a first come, first served basis, for up to the maximum number of people listed in the offer details.

4. 4. Packages

   1. All Packages are non-transferable and cannot be used by any persons other than Participants.
   2. When booking air travel and hotel stays together under a Package, the booked hotel stay must: (i) match the itinerary dates of the booked air travel and (ii) include a minimum of 1 night. Such booked hotel stays must be located in the Package destination, as determined by American Airlines Vacations in its sole discretion.

5. 5. Third Party Products and Services

   1. Each Package and Experience may contain components including goods, services and accommodations (e.g., excursions and tours) provided by third-party vendors, including but not limited to, airlines, hotels, rental car companies, transportation companies, suppliers, tourist facilities and excursion operators ("Third-Party Vendors"). Each Package or Experience component provided by a Third-Party Vendor may be referred to individually as a "Third-Party Activity". Third-Party Activities may be subject to the terms and conditions of Third-Party Vendors, which may change from time to time without notice. Age restrictions imposed by Third-Party Vendors may apply (e.g., some hotels may require that at least one guest be 21 years of age or older).
   2. All flights operated by American Airlines, Envoy Air, PSA Airlines, Piedmont Airlines, Republic Airways Inc, Air Wisconsin Airlines LLC, and Skywest Airlines LLC and marketed under the American Airlines code that are booked as a component of a Package are subject to the Conditions of Carriage Opens in a new window and all applicable fare rules and restrictions. Some discounted airfares may not be eligible for: (i) upgrades to another class of service, or (ii) AAdvantage^® miles, which are subject to the AAdvantage^® Terms and Conditions Opens in a new window . Eligible fare classes of an air component of a Package may change at any time without notice prior to the time of booking.
   3. American Airlines Vacations provides accommodations to Participants with special needs with regard to flights. Third-Party Vendors may not have the appropriate equipment or provide the services necessary to accommodate Participants with disabilities or special needs. Please advise American Airlines Vacations of any special requests at the time of booking by calling 800-321-2121 at least 15 days prior to the outbound departure date for a Package or the Experience date (as applicable). American Airlines Vacations will thereafter forward such special requests to the appropriate Third-Party Vendors. Additional fees and charges necessary to accommodate special requests may apply. American Airlines Vacations does not guarantee that any special requests will be accommodated.
   4. American Airlines Vacations is not responsible for Third-Party Activities.

6. 6. Pricing and Redemptions for Experiences

   1. All Experiences are available solely as redemptions of AAdvantage^® miles.
   2. Full redemption in AAdvantage^® miles is required at the time of booking an Experience. Prior to full redemption, the redemption value of an Experience is not guaranteed.
   3. Experiences may be subject to extra charges for items not specified in the Experience's description (e.g., parking fees).
   4. AAdvantage^® miles must be redeemed from a single AAdvantage^® account. You may not combine AAdvantage^® miles from two or more accounts to redeem for a single Experience.
   5. An Experience is considered confirmed once AAdvantage^® miles are redeemed by American Airlines Vacations.
   6. Adjustments to Experience redemption requirements will not be made after full payment is received, and redemption reductions subsequent to booking will not be retroactively applied. American Airlines Vacations reserves the right to correct any payment errors.

7. 7. Pricing and Payment for Packages

   1. All Package prices are in U.S. dollars. Packages may be purchased in full for cash, redeemed in full in AAdvantage^® miles, or acquired through a combination of cash and AAdvantage^® miles as determined by American Airlines Vacations.
   2. Full payment or redemption is required at the time of booking a Package. Prior to full payment or redemption, prices, travel dates, availability of hotel rooms, car rentals, flight seats and other Package components are not guaranteed. American Airlines Vacations reserves the right to treat a booking as cancelled if the balance due is not paid or redeemed on time. A Package is considered confirmed once payment and/or redemption is received by American Airlines Vacations.
   3. If a Package is redeemed in whole or in part in AAdvantage^® miles, such AAdvantage^® miles must be redeemed from a single AAdvantage^® account. You may not combine AAdvantage^® miles from two or more accounts to redeem for a single Package.
   4. All airfares include required government taxes, segment fees, airport passenger facility charges (PFC's), September 11th Security Fees and federal segment fees. American Airlines Vacations prices and rates do not include extra charges (e.g., paid seats, ancillaries) imposed by airlines. Resort fees, meals, shows, tours, tips, energy surcharges, telephone surcharges, telephone calls, liquor, taxes, room service, laundry, parking fees, pet fees or other items not otherwise specified in the quoted rates are excluded from the Package price.
   5. Special children's rates may be available and quoted with the total Package price. Additional charges for cribs, rollaway beds, infant car seats and similar special request items will be the responsibility of the Participant(s) and must be paid directly to the applicable Third-Party Vendor.
   6. Adjustments to Package pricing will not be made after full payment or redemption is received, and rate reductions subsequent to booking will not be retroactively applied. American Airlines Vacations reserves the right to correct any payment errors. Government taxes and fees are subject to change after purchase or redemption.

8. 8. Changing or Cancelling a Booked Experience

   1. If you are no longer able to attend an Experience, please inform American Airlines Vacations by phone at 800-321-2121.
   2. Experiences are non-refundable (except if cancelled by American Airlines Vacations), unless the particular Experience contains terms or conditions that specifically set forth return, cancellation, change or exchange policies.

9. 9. Changing a Booked Package

   1. Changes to a booked Package are subject to the change fees described herein and cannot be made 8 days or fewer prior to the original outbound departure (unless covered by PDP (as defined below)).
   2. If a change to a Package component involves a change in the corresponding Package component rate (e.g., due to a change in flight origin and destination, departure date, or hotel room category or configuration), such Package component will be repriced at the applicable rate then in effect, and full payment will be required at the time of such change.
   3. Some Packages or Package components, including, but not limited to, Basic Economy fare tickets and Non-Refundable Components cannot be changed after purchase. "Non-Refundable Components" means those promotional tours, specific room categories and other activities that are identified in the booking path as non-refundable, advance purchase or restrictive.
   4. American Airlines Vacations may, at its discretion, waive a change fee if: (i) the change results in a higher price for the non-air components of the Package; or (ii) an upgrade from main cabin to a premium cabin is purchased by a Participant. Certain name changes, as American Airlines Vacations may determine in its sole discretion, may be permitted without a fee.
   5. All changes to Packages (unless covered by PDP or waived by American Airlines Vacations) will be subject to the following:

10. 10. Cancelling a Booked Package

    1. All requests to cancel a Package must be made by phone at 800-321-2121, on the travel agent portal if the Booker is a travel agent, or in another manner specified by American Airlines Vacations. Upon cancellation of a Package, if a credit is due, the first traveler listed on the booking will receive the credit for future bookings on the American Airlines Vacations platform, subject to any applicable cancellation penalties. Cancellations to a booked Package cannot be made 14 days or fewer prior to the original outbound departure (unless covered by PDP). Package cancellations 15 days or more in advance are subject to the following cancellation penalties (unless covered by PDP or waived by American Airlines Vacations):

11. 11. Package Refunds

    1. Within 24 hours of booking a Package, a Package (whether refundable or non-refundable) may be cancelled, and a full refund of the Package (subject to any applicable Non-Refundable Components, Third-Party Vendor Fees and Basic Economy fares) may be issued for the price paid for the corresponding tickets in accordance with the following rules and restrictions:
       • You must call 800-321-2121 within 24 hours of booking to cancel and request a refund for the Package.
       • Refunds may be issued only to the original form of payment.
       • Refunds are only available for Packages purchased at least 2 days prior to the scheduled outbound departure date.
       • Cancellations and refunds after 24 hours of booking a Package are governed by the provisions of Section 10 above.
       • To the extent that you are entitled to a refund, American Airlines Vacations will only issue refunds for entire Packages and not for individual Package components.
       • American Airlines Vacations will not issue refunds or exchanges for any missed or unused Package components including, but not limited to, unused hotel nights and rental car periods.
    2. Your acceptance of a refund constitutes a waiver of all rights and remedies under applicable laws other than the amount of the refund.

12. 12. Changes or Cancellation by American Airlines Vacations

    1. American Airlines Vacations reserves the right to cancel a Package or Experience without penalty for any reason upon 30 days' prior written notice to you. If American Airlines Vacations cancels a Package or Experience, American Airlines Vacations will provide you with a refund to the original form of payment for the cancelled Package or Experience.
    2. The supplier of each component of a Package or Experience (whether American Airlines Vacations with respect to flights, or Third-Party Vendors with respect to other components) reserves the right to remove any Participant from a Package or Experience at any time.
    3. American Airlines Vacations may immediately cancel a Package or Experience for cause, in whole or in part, upon the occurrence of any of the following events:
       • The Package or Experience, or any component thereof, is used for any purpose other than personal leisure.
       • The Package or Experience, or any component thereof is transferred or attempted to be transferred.
       • The Package or Experience is booked, acquired or modified in a fraudulent manner.
       • You breach any provision of these Terms or any other applicable terms and conditions.
    4. Upon cancellation of a Package or Experience by American Airlines Vacations due to fraud, American Airlines Vacations may delay delivery of a refund until American Airlines
    5. Vacation has determined the proper recipient and amount of the refund.
    6. American Airlines Vacations will not be liable for cancellations or changes to a Package or Experience that are due to events beyond its control.

13. 13. Pre-Departure Protection (PDP) for Packages

    1. Pre-Departure Protection ("PDP") is an optional plan for Packages that allows you to: (i) change your booked Package 8 days or more prior to the original outbound departure date without any fees other than Non-Refundable Components, (ii) change your booked Packaged fewer than 8 days prior to the original outbound departure date without any fees other than Non-Refundable Components and certain Third-Party Vendor fees, and (iii) cancel your booked Package entirely at any time prior to your originally scheduled departure time without incurring any cancellation penalties other than Non-Refundable Components.
    2. Each Third-Party Vendor may have their own cancellation and refund policies.
    3. PDP coverage is subject to the following restrictions:
       • PDP does not cover any increase to the price of a Package component as a result of a change.
       • PDP does not cover changes to flight schedules.
       • PDP does not cover Basic Economy fares or Non-Refundable Components
       • PDP does not cover any non-refundable Third-Party Vendor fees for changes or cancellations, which are considered Non-Refundable Components.
       • Bookings at Sandals Resorts, Beaches Resorts and Grand Pineapple Resorts become non-refundable on the 45th day prior to the departure date, and are therefore considered Non-Refundable Components. PDP does not cover changes or cancellations after such date.
       • PDP does not cover changes or cancellations to a Package after commencement of travel.
       • PDP does not eliminate charges or cancellation fees for no-shows.
       • PDP charges are non-refundable.
       • PDP may only be purchased for a Package as a whole (i.e., PDP coverage for some Participants and not others is not permitted).
       • PDP may only be purchased when a Package is booked and may not be added at any point thereafter.
       • PDP is non-transferable.
       • PDP coverage may not be available to purchase for Packages covering certain blackout dates (e.g., Thanksgiving, Christmas or New Year's Day) that American Airlines Vacations may, in its sole discretion, implement form time to time.     4. All cancellations of Packages prior to scheduled outbound departure that are covered by PDP will be fully refunded to the original form of payment, minus the costs of any Non-Refundable Components.
    5. The cost of PDP is not refundable once purchased.

14. 14. AAdvantage® earn

    1. Participants will not earn any AAdvantage^® miles or Loyalty Points in connection with Experiences, since Experiences are available solely as redemptions of AAdvantage^® miles.
    2. Notwithstanding the AAdvantage^® Terms and Conditions, Participants who are included in a Package booking as of the departure date will earn AAdvantage^® miles and Loyalty Points (defined in the AAdvantage^® Terms and Conditions) based on the AAdvantage^® status of the Participant with the highest AAdvantage^® status as follows:
       • Every dollar spent on the total Package value (excluding taxes, fees, and mileage redemption), will be multiplied by the American Airlines Vacations multiplier applicable to the Participant with the highest AAdvantage^® status to determine the total amount of AAdvantage^® miles and Loyalty Points available for distribution to Participants. This total available amount of AAdvantage^® miles and Loyalty Points will be divided by the total number of Participants (regardless of whether every Participant is an AAdvantage^® member) to determine the amount of AAdvantage^® miles and Loyalty Points that each Participant who is an AAdvantage^® member will earn.
       • To receive AAdvantage^® miles and Loyalty Points in full, each Participant must be an AAdvantage^® member. If any Participant is not an AAdvantage^® member, the calculations above will still be performed but the non-member Participant(s) will not receive their allocation of AAdvantage^® miles or Loyalty Points and the AAdvantage^® miles and Loyalty Points that otherwise would have been allocated to such non-member Participant(s) will be invalid (i.e., they will not be deposited in or transferable to the account of the Booker or any Participant). If an AAdvantage^® member's AAdvantage^® number is not included in the Package booking, such individual will not be considered an AAdvantage^® member for purposes of earning AAdvantage^® miles and Loyalty Points.
    3. Only Participants included in the Package booking as of the departure date may earn AAdvantage^® miles or Loyalty Points in connection with a Package. If an individual participates in a Package component without being part of the Package booking as of the departure date, such individual will not earn any AAdvantage^® miles or Loyalty Points in connection with the Package.
    4. Certain airfares are not eligible to earn AAdvantage^® miles.
    5. American Airlines Vacations reserves the right to change our mileage accrual plan at any time.

15. 15. Disclaimers

    1. American Airlines Vacations is not an agent of the person booking a Package or Experience or of any Third-Party Vendors. AMERICAN AIRLINES VACATIONS IS NOT RESPONSIBLE FOR THE QUALITY OR DELIVERY OF ANY THIRD-PARTY ACTIVITY, AND AMERICAN AIRLINES VACATIONS DOES NOT ACCEPT AND HEREBY EXPRESSLY DISCLAIMS ANY LIABILITY FOR THE ACTIONS OR OMISSIONS OF A THIRD-PARTY VENDOR PROVIDING A THIRD-PARTY ACTIVITY. Further, your booking of a Third-Party Activity will not create a contract between you and American Airlines Vacations. Any such contract is between you and the Third-Party Vendor providing such Third-Party Activity. AMERICAN AIRLINES VACATIONS WILL NOT BE RESPONSIBLE FOR THE PROVISION OF ANY THIRD-PARTY ACTIVITY OR FOR ANY ACT OR OMISSION DURING THE COURSE OF ITS PROVISION BY THE THIRD-PARTY VENDOR REGARDLESS OF WHETHER A MEMBER OF THE AMERICAN AIRLINES VACATIONS STAFF ACCOMPANIES THE RELEVANT THIRD-PARTY ACTIVITY. All documents issued by Third-Party Vendors for Third-Party Activities (e.g., vouchers, tickets and passes) are issued subject to the terms and conditions specified by such Third-Party Vendors.
    2. NEITHER AMERICAN AIRLINES VACATIONS NOR ITS PARENT(S), SUBSIDIARIES, AFFILIATES, DIVISIONS, ADVERTISING AND PROMOTIONAL AGENCIES, WHOLESALERS AND RETAILERS, EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS AND AGENTS (COLLECTIVELY THE "RELEASED PARTIES") WILL BE HELD LIABLE FOR, AND YOU WAIVE ANY AND ALL CLAIMS AGAINST ALL RELEASED PARTIES FOR: (I) ANY LOSS OF OR DAMAGE TO PROPERTY OR INJURY TO ANY PERSON CAUSED BY REASON OF A DEFECT, NEGLIGENCE OR OTHER WRONGFUL ACT OR OMISSION OF OR ANY FAILURE OF PERFORMANCE OF ANY KIND BY ANY THIRD-PARTY VENDOR OR OTHER DAMAGE CAUSED BY FACTORS OUTSIDE OF American Airlines Vacations' CONTROL; (II) ANY INCONVENIENCE, LOSS OF ENJOYMENT, MENTAL DISTRESS OR OTHER SIMILAR MATTER; (III) ANY SUBSTITUTIONS OF ACCOMMODATIONS, TERMINATION OF SERVICE OR CHANGES IN FARES AND RATES OR OTHER UNFORESEEN CIRCUMSTANCES; AND (IV) ANY CANCELLATION OR DOUBLE-BOOKINGS UNDER ANY PACKAGE OR EXPERIENCE BEYOND THE CONTROL OF AMERICAN AIRLINES VACATIONS.
    3. TO THE MAXIMUM EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL AMERICAN AIRLINES VACATIONS OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, THE USE OF OR INABILITY TO USE ANY AMERICAN AIRLINES VACATIONS PRODUCTS OR SERVICES, INCLUDING ANY PACKAGE OR EXPERIENCE, OR THIRD-PARTY ACTIVITY, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER AMERICAN AIRLINES VACATIONS WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.
    4. American Airlines Vacations' liability will also be limited in accordance with any relevant international conventions in relation to the provision of travel or accommodation services which are hereby incorporated into and form part of the agreement between you (including each Participant) and American Airlines Vacations. American Airlines Vacations will be regarded as having all the benefits of any limitation of compensation or liability contained in any such international conventions.

16. 16. Indemnification

    1. You are responsible for your use of the American Airlines Vacations' products and services (including Packages and Experiences) and for your use of any Third-Party Activity and for any and all claims, demands, proceedings, suits and actions, including any related liabilities, obligations, losses, damages, deficiencies, penalties, taxes, levies, fines, judgments, settlements, expenses (including legal and accountants' fees and disbursements) and costs (collectively, "Claims") that arise in connection with your use of American Airlines Vacations' products or services (including Packages and Experiences) or any Third-Party Activity.
    2. You agree to indemnify, defend, and hold harmless American Airlines Vacations and its affiliates from and against any Claims based on, arising out of or resulting from your use of American Airlines Vacations' products or services (including Packages and Experiences) or any Third-Party Activities, including any Claims alleging facts that if true would constitute your breach of these Terms.

17. 17. Forum for actions, governing law, and procedural restrictions

    1. If you are (i) an individual who is either a U.S. Citizen or a resident of the U.S. or its territories or (ii) an entity, you agree that these Terms are made and entered into in Tarrant County, Texas. You agree that Texas law governs the interpretation of these Terms or any dispute arising from your access to, dealings with, or use of American Airlines Vacations' products or services (including Packages and Experiences), without regard to conflicts of law principles. Except as set forth below, any lawsuit brought by you related to your access to, dealings with, or use of any American Airlines Vacations' products or services (including Packages and Experiences) must be brought in the state or federal courts of Tarrant County, Texas.
    2. If you are an individual, and you are neither a U.S. citizen nor a resident of the U.S. or its territories, you agree that any dispute or claim (including non-contractual disputes or claims) arising from or related to any American Airlines Vacations' products or services (including Packages and Experiences) or these Terms, or their subject matter or formation) shall be governed by the laws and courts of your usual place of residence, without regard to any conflict of law provisions, and you irrevocably submit to the non-exclusive jurisdiction of such courts.
